The Palestinian Centre for Human Rights (PCHR): Weekly Report on Israeli Human Rights Violations in the Occupied Palestinian Territory (oPt)

Summary for September 2 – 8, 2021

Israeli forces continued to commit crimes and multi-layered violations against Palestinian civilians and their properties, including raids into Palestinian cities that are characterized with excessive use of force, assault, abuse, and attacks on civilians, turning the West Bank into isolated blocks of land. Israeli settlement expansion on Palestinian properties and land continued.

The Israeli settlement expansion works continued on Palestinian lands and properties. This week, the Israeli prison authorities conducted a retaliatory oppression campaign and collective punishment against hundreds of Palestinians in Israeli prisons in the aftermath of Palestinians fleeing Galboa prison earlier this week. Meanwhile, the Gaza Strip enters its 15th year under closure, exacerbating the humanitarian hardships across the territory.

Army shooting and violation of right to bodily integrity:

The army’s excessive use of force rendered 4 Palestinians wounded in the West Bank and Gaza Strip. One was wounded during army attacks on Kufur Qaddoum weekly peaceful protest in Qalqilia; a child suffered fracture in the skull and was deemed critical after the army attacked him during a raid in Jenin. Also dozens suffocated due to tear gas inhalation as soldiers suppressed protests across Palestinian cities against the attacks on Palestinian prisoners. In the Gaza Strip, a fisherman was wounded at sea in northern Beit Lahia, and a child in Khan Younis. Also, six Israeli Navy shootings were reported against Palestinian fishing boats in the Gaza Sea.

Israeli Army incursions and arrests of Palestinian civilians:

The army carried out 143 incursions into the West Bank, including occupied East Jerusalem. Those incursions included raids of civilian houses and shootings, enticing fear among civilians, and attacking many of them. During this week’s incursions, 62 Palestinians were arrested, including 10 children.

Demolitions:

PCHR fieldworkers documented 6 violations:

Occupied East Jerusalem: 2 houses completely self-demolished, as well as parts of a third house. Authorities commenced work the Martyrs Cemetery adjacent to al-Yousifiyeh Cemetery in al-Asbat Gate area. The army also confiscated a wheel loader.

Hebron: works stopped at a land, and an excavator confiscated in Dura.

Israeli closure policy and restrictions on freedom of movement:

This week, the Israeli occupation announced closure of all crossings with the West Bank and the Gaza Strip starting 16:00 on Monday 6 September 2021 until midnight 9 September 2021 for Rosh Hashanah. In its press statement, the Israeli military said, “As per security assessment and political directives, a total lockdown will be imposed on the West Bank and the Gaza crossings for the Jewish holidays.” “All commercial crossing will be closed, only exceptional humanitarian, and medical cases will be allowed through the crossing subject to approval of the Coordinator of Government Operations in the Palestinian Territories.”

Meanwhile, Israeli occupation authorities continued to ban the entry of dozens of goods, including construction materials, in collective punishment measures against the Gaza Strip as the Israeli closure imposed on the territory entered its 15th year, without an end in sight that would fulfil Palestinians’ right to enjoy their economic, social, and cultural rights.

On Wednesday, 8 September 2021, authorities announced that the closure of West Bank crossings will be in effect until midnight Sunday, 12 September 2021.

Meanwhile, the occupation continued to divide the West Bank into separate cantons with key roads blocked by the Israeli occupation since the 2000 Second Intifada -still closed to this date- and with temporary and permanent checkpoints, where civilian movement is restricted, and they are subject to arrest, especially at al-Karama border crossing, alongside the Palestinian-Jordanian border.

a. Demolitions, Confiscations, and Notices

• On Saturday morning, 04 September 2021, Ahmed Younis Abu Wahdan demolished his own house in Wadi Rababah neighborhood in Silwan village, south of occupied East Jerusalem’s Old City, pursuant to the Israeli Municipality’s decision under the pretext of unlicensed construction.

Abu Wahdan said that he built a small house in Wadi Rababah neighborhood in Silwan village so that his mother would live next to him; however, he did not finish the house from inside after the army handed him a decision to stop construction works at the time. Abu Wahdan added that his 50-sqm house remained as it is for 10 years until he received a notice a month ago to demolish the house and threatened him if he did not self-demolish the house, the municipality will send its crews to do so and fine him with tens of thousands of shekels for the municipal demolition costs. Abu Wahdan said that he had to demolish the house that cost him 60,000 shekels with hand tools, as he cannot afford paying high fines to the Israeli Municipality.

• On Sunday morning, 05 September 2021, Fayez Izheiman self-demolished parts of his house in Beit Hanina neighborhood, north of occupied East Jerusalem, for the second time pursuant to the Israeli Municipal decision under the pretext of unlicensed construction.

Fayez Izheiman said that he started house repairs but was surprised with Israeli municipality’s raid into his house and fining him with 9000 shekels. They also ordered him to remove the living room’s roof and door as well as part of the wall. Izheiman said that he self-demolished the notified parts fearing that the municipal crews will do so. He added that in 2020 he had to repair the house again as he do not have any other place to live in, so he replace the living room’s roof with a one made of wood.

However, the Israeli municipality has again haunted him and referred him again to the court, which decision to demolish the living room’s walls and roof, giving him until the beginning of the next month to implement the decision. Izheiman said that he had to implement the decision again fearing the high fines. He added that he rented another house next to his old one to live with his pregnant wife and 2 daughters because his house has become unguarded without a door while part of it has become unroofed. He explained that his old house was 60 sqms and included a bedroom, living room, a kitchen, and a bathroom.

• At approximately 09:00 on the same day, the Israeli municipal crews and Israel’s Nature Authority resumed the excavations in the Martyrs Cemetery adjacent to al-Yousifiyeh Cemetery in al-Asbat Gate area in central occupied East Jerusalem and entered iron reinforcement networks and concrete to prevent burial in cemetery and turn it into a biblical garden.

Mustafa Abu Zahrah, head of the cemeteries committee in Jerusalem, said that Israel’s Nature Authority and Municipality crews raided the cemetery and started leveling its land and carryout excavations. They then brought red sand and iron reinforcement networks to pour the concrete in the cemetery land in order to prevent burial and turn it into a biblical garden to entrench the Jewish existence in the City. Abu Zahrah explained that the Martyrs and al-Yousifiyeh Cemeteries have been exposed for years to consecutive attacks that included the cemetery’s fence adjacent to al-Asbat Gate and removing its archaeological staircase as well closing the staircase leading to it and carrying out excavation works in the street starting from the door and to the Friday Market adjacent to the northern fence; all of that was allegedly for excavation and reparation works.

Abu Zahrah added that the Islamic Cemeteries Committee resorted to the Israeli court and submitted the documents proving that the cemetery belongs to the Islamic Endowments. He said that at the end of the year, the court issued a decision to ban any works in the cemetery; however, afterwards, someone was buried in the cemetery and this tomb was taken as an excuse to invalidate the decision. At the end of July, the Israeli Court’s judge responded to the Israel’s Nature Authority and municipality’s request to resume the excavation works in the cemetery’s land after months of the court’s decision to suspend them.

It should be noted that al-Yousifiyeh Cemetery is one of most prominent cemeteries in Jerusalem that is located to the north of al-Asbat Gate and includes tombs for Palestinian families living in Jerusalem while to the northern side there is the Martyrs Cemetery that encompasses the bodies of Jordanian soldiers who died in 1967. In 2014, the army destroyed 20 tombs of them and banned burial in its northern side.

All the equipment were taken to the road leading to the nearby “Negohot” settlement and then to “Ghosh ‘Etzion” settlement, south of Bethlehem. They also handed Abu ‘Atwan a warrant of the confiscated equipment. IOF claimed that the land is located in Area C, where work is banned without a prior permission from the Israeli Civil Administration.

• On Tuesday morning, 07 September 2021, ‘Abed Dweik self-demolished his house in Silwan village, south of occupied East Jerusalem’s Old City, pursuant to the Israeli Municipality’s decision allegedly for unlicensed construction.

Dweik Family said that they built their house 4 years ago in al-Bustan neighborhood in the village, and since then the Israeli municipality has haunted them in the courts and imposed fines. The family said that the Israeli court issued a final decision 20 days ago to demolish the house, giving the family only until mid-month to implement the decision or the musicality crews will do so and fine the family with thousands of shekels for the demolition costs. The family added that the house is 80 sqms and housed 9 individuals, including 7 children.

• At approximately 09:00 on Wednesday, 08 September 2021, the army confiscated a bulldozer belonging to Na’im Ghaith while working in Beit Eksa village, northwest of occupied East Jerusalem.
